Terms of Service of the www.sygnalizuj.pl Platform Valid from April 29, 2024
Rules for using the platform
These regulations define the terms of use of the www.sygnalizuj.pl platform, including the terms of service provision by the Provider in accordance with the Act of 18 July 2002 on the provision of services by electronic means.
The scope of services offered by the Provider
The Provider provides various electronic services, including enabling the Whistleblower to send information to the Company, providing access to the Company Account and the Company Panel, and enabling the Whistleblower to receive a response from the Company to his or her report.
Definitions
Price table - a list of prices for services available on the platform for the Company (Appendix No. 1).
Company Account - a dedicated space on the platform created for the Company after the registration process is completed.
Company Panel - a section within the Company Account where reports regarding this Company are collected.
Company - an entity that may be a natural person, a legal person, a public entity or another entity without legal personality, and whose activities are the subject of reports on the platform.
Report Recipient - a person or team of people designated by the Company to manage and operate the Company Panel. Report Recipients may perform various functions and have various permissions within the platform.
Regulations - this document defining the rules of using the www.sygnalizuj.pl platform.
Registration - the process of entering information into the Company Account, necessary to activate the services available on the platform.
Platform - internet service available at www.sygnalizuj.pl.
Whistleblower - a person using the platform to make a report.
Service - a set of functions offered by the platform, including the ability to submit reports, access to the Company Account, access to the Company Panel, viewing reports and responding to them by the Company.
Contract - a contract regarding the provision of services concluded between the Provider and the Company, based on the acceptance of these Regulations.
Provider - Mediapark Sp. z o.o. with its registered office in Olsztyn at 10 Władysława Trylińskiego Street, registered in the National Court Register under number 0000718893, Tax Identification Number 7393910693, REGON 369505866.
User - any person visiting the platform, including the Whistleblower and the Recipient of the report.
Report - a message sent by the Whistleblower to the Company in relation to its activities, made via the platform.
Introductory Provisions
These Regulations define the terms of use of the Platform, which enables the Whistleblower to provide information regarding the Company's activities and the Company to review and respond to such information.
Only the Whistleblower and the Recipients designated by the Company have access to the content of the report.
The use of the Platform by the Whistleblower is free of charge. The Company gains access to its Account and Company Panel by selecting one of the three available packages in accordance with the Price Table.
The first fee for the Company is charged when registering the first Administrator, while each subsequent fee is charged when extending the Company's Account on the Platform in accordance with the Price Table applicable on that day.
Start of use of the platform by the Whistleblower
By starting to use the platform, the Whistleblower accepts the terms of these Regulations, although he or she is not a party to the Contract.
Conclusion and Term of the Contract
The Company accepts the terms of these Regulations and provides the required information.
Adding a Company to the Platform:
This is done by selecting one of the three available packages:
Basic Package
Optimal Package
Affiliate Package
Some of the paid packages may be made available in a test version. After the test version expires, if the Company does not choose a paid package, the service will be blocked.
A company can change the package by:
Contacting the hotline and submitting a declaration of intent to change the package to the consultant.
The description of the option selected by the Company and its price are binding on the parties.
The Provider may change the functions and prices of the packages and announce this on the portal.
Payment for the Package:
After completing the registration and choosing a paid package, the Company is required to make the payment. Changes to the Company's data are subject to verification by the Provider.
Provision of Service:
Services within the packages are ordered for an indefinite period. The company undertakes to pay the amount due for using the package on time. Payments are made in advance within 7 days of the start of the first billing period and 14 days of the start of subsequent billing periods. The company settles annually.
Duration of the Contract:
The period of validity of paid packages begins on the date of submission of the declaration of intent by the Company and lasts until the end of the billing period during which the Company submits notice of termination.
Account Registration:
Registering a Company Account results in concluding a contract with the Provider for a specified or indefinite period. The Regulations are an integral part of the contract.
Minimum Contract Period:
The initial contract must be for at least one year.
Account Administrator:
The Company designates an Administrator to manage the account with the option of granting access to other people.
Internet address:
During registration, a dedicated internet address is set on the Platform domain for the Company. Reports from Whistleblowers are forwarded to the Recipient, and the Company is obliged to inform employees of this address.
Payments, Extensions and Termination of Contract
Long Term Payments:
A company can choose to pay annually in advance or for multiple billing periods in advance.
Automatic Extension of Contract:
After the first year, the contract is automatically extended for an indefinite period, unless the Company declares its disinclination to extend it before the end of the contract.
Extension Terms:
Automatic extension of the contract takes place under the price conditions in force on the date of extension and in accordance with the regulations.
Price List and Regulations:
Detailed information on tariff plans and fees after contract extension is available on the sygnalizuj.pl website.
Change of Subscription Amount:
The change of subscription is effective from the calendar month following the month of notification of the change, unless the Company does not consent to the change within 7 days.
Delays in Payments:
In case of delay, the Provider has the right to block access to the Company's account. The Provider will call on the Company to pay the overdue payments.
Deletion of the account:
After the payment deadline has expired without success, the Provider has the right to delete the Company's account, which results in the termination of the contract. Fees paid before the termination of the contract are not refundable.
Subscription Guarantee:
The provider guarantees the subscription to remain unchanged for the duration of the contract. The guarantee does not apply to the extension of the contract.
Electronic Invoices:
The Company authorizes the Provider to issue and send electronic invoices. The Company and the Provider undertake to notify about changes in the invoice data 5 days in advance.
Priority of Written Contract:
A written contract takes precedence over provisions contained in the regulations or price list.
Termination of the Contract:
The contract may be terminated with a 14-day notice period. In the event of termination due to the fault of the Provider, the Company is entitled to a proportional refund of the fee.
Immediate Termination of the Contract:
The Provider may terminate the contract immediately in the event of a breach of the regulations by the Company. In such a case, the fee is non-refundable, but the Company has the right to archive the reports for 14 days.
Obligations and rights arising from the use of the Platform
All users of the Platform, i.e. the Company, the Recipient and the Whistleblower, must comply with applicable laws and social norms when using the Service.
Platform Users may not transmit content that is contrary to law.
The Company and the Recipient are obliged to maintain the confidentiality of their access data, including the password and unique Report ID number.
The whistleblower is responsible for protecting his or her password and unique Report ID number.
The Company is not entitled to transfer its rights and obligations under the Contract to another entity without the written consent of the Provider. The Company may not sell or transfer its Account on the Platform to another person or company.
The Company is obliged to immediately inform the Provider of any changes to the data provided during Registration electronically. The Company is responsible for the consequences resulting from failure to inform the Provider of the changes.
The Company undertakes to inform each Recipient about the scope of personal data made available to them and to fulfill the information obligations arising from the GDPR.
All actions of users should be consistent with good manners and not violate the rights of other users or the Provider.
Responsibility
The Provider is not responsible for the content of reports submitted by the Whistleblower.
The Provider shall not be liable for any actions or omissions of the Company in response to reports.
The Provider is not liable for any damages resulting from the use or inability to use the platform.
The Provider makes every effort to ensure the proper operation of the platform, but does not guarantee its continuous availability.
In cases resulting from the fault of the Provider, the Provider's liability is limited to a maximum amount equal to the fee paid by the Company for the annual use of the Platform.
Complaints
The user has the right to submit complaints regarding the operation of the platform.
Complaints should be sent to the following e-mail address: bok@sygnalizuj.pl.
The complaint must include the reason for dissatisfaction and a description of the problem.
The Provider undertakes to consider each complaint within 14 days of its receipt and inform the User of the outcome of the complaint procedure.
If the complaint is accepted, the Provider undertakes to immediately remove the faults or defects of the platform.
Technical matters
The Provider makes every effort to ensure the proper functioning of the platform, but does not guarantee its continuous availability.
The Provider is not responsible for any interruptions in the operation of the platform caused by external factors (e.g. Internet service provider failure, hacker attack).
The Provider reserves the right to perform maintenance work on the server on which the platform operates, which may result in temporary interruptions in its availability. Users will be informed of this in advance.
The Provider recommends using the latest versions of web browsers to ensure optimal operation of the platform.
In case of technical problems related to the use of the platform, the User should contact the Provider via the contact form available on the platform or to the e-mail address provided.
Personal data
Matters related to the processing of personal data are regulated in the Privacy Policy.
Final Provisions
These Regulations come into force on the date of their posting on the Platform and constitute an inseparable part of the agreement regarding the provision of the Service.
Any modifications to the Regulations become effective at the time of their presentation on the Platform. By accepting the Regulations, the User agrees to the possibility of unilateral modification of the Regulations by the Provider.
The Provider shall inform the Company about any updates to the Regulations and the Price Table via an e-mail sent to the address provided during Registration.
Both the Provider and the User strive to resolve any disagreements through negotiation and agreement.
The text of the Regulations and the Privacy Policy is available to everyone on the main page of the Platform (www.sygnalizuj.pl).
In matters not covered by the Regulations, the relevant provisions of Polish law shall apply, in particular the Civil Code and the Act on the provision of services by electronic means.
